A 17-year-old highschool student testified at a preliminary hearing this week about his ‘special” relationship with his former english teacher at Davis High School in Utah.

Brainne Altice is charged with having a sexual relationship with two teens at the school. The student testified that between April and May of last year he and the teacher were involved in a inappropriate relationship. He gave graphic details how the two began with simple kissing between periods, which led to full on sexual intercourse.

“Instead of a friend with benefits, she was a teacher with benefits.” when asked to describe the relationship with Altice, who was married and has a child.

At a preliminary hearing in February the first boy testified that he was 16 years old when he had several sexual encounters with Altice between January and September of 2013. At that hearing, a judge found there was probable cause and ordered the woman to stand trial on three counts of rape and one charge of forcible sodomy.

A trial had been scheduled for this month, but prosecutors filed additional charges in July related to the second boy’s allegations.

The teen testified on Friday that he told authorities about his relationship with the former teacher in October of last year — the same day she was arrested for charges related to the first teen.

But in July, he went to prosecutors and told them it was all lie.

However, on the stand Friday, he testified that he was telling the truth, and that the inappropriate relationship happened.

In explaining his reasoning for telling investigators he made up the allegations he said “I felt sorry for her kids more than her,” he testified on Friday. “Obviously, she knew what she was doing. I was just thinking about her kids,  I grew up without my mom.”

Altice was arrested last October for the alleged incidents involving the first student, now she faces a total of nine felony counts involving a second student.

Farmington 2nd District Judge John Morris ordered her on Friday to return to court on Oct. 9 to face three counts of rape and one charge of forcible sodomy.

Altice pleaded not guilty to all counts. Her attorney Ed Brass argued she did not use her position as a teacher to persuade the teen into having a sexual relationship. He argued she gave in to the student’s constant flirting. Utah law states that a victim cannot consent to sex if the other person is in a position of special trust.

During Friday’s hearing, Brass cross examined the teen asking questions concerning dates and the timeframe as to when the alleged sexual contact occurred.

Prosecutors said the teacher admitted to investigators that she had engaged in sex with the 16-year-old boy on two occasions.

But Brass has asked the judge to not allow those statements at her trial, arguing that Altice was intimidated by the eight to 10 male officers who came to her home last October to interview her about the allegations.

The attorney claimed that the officers refused to let her care for her child, contact an attorney or use the restroom for nearly four hours as they interrogated her.

“The statements were coerced and involuntary and were taken in violation of her so-called Miranda rights,’ Brass wrote in court papers. “The evidence she provided was the product of that tainted statement.”

Altice was fired from Davis High School in February. She currently remains free on $10,000 bail.

The husband of Altice has since filed for divorce and custody of their child in December.
