A prosecutor will seek the death penalty for a suburban Philadelphia couple who brutalized and killed a 3-year-old boy, Chester County District Attorney Tom Hogan said at Wednesday’s arraignment.

Gary Fellenbaum, 23, and the boy’s mother Jillian Tait, 31, pleaded not guilty to the torture death of 3-year-old Scott McMillan as about 20 people — raising awareness about child abuse and waving signs that read “Justice for Scotty” — protested outside Chester County Justice Center, The Philadelphia Inquirer reported.

“Our ER nurses see a lot of terrible things. But when they saw his body, they wept,” said Hogan, who tied the death penalty to the torture death of a child younger than 12 statute.

Also arrested was Amber Fellenbaum, Gary Fellenbaum’s ex-wife, who lived with the pair with her 11-month-old child. She called 911, but was charged with endangering the welfare of children and reckless endangerment.

The couple waived their right to a preliminary hearing Dec. 18.

The Pennsylvania horror unfolded in a mobile home near Coatesville, 35 miles outside Philadelphia. When Scott refused to eat toast, Fellenbaum, his mother’s boyfriend, allegedly began a three-day pattern of physical abuse that ended in the child’s death on Nov. 4

 

Gary Fellenbaum struck Tait’s 6- and 3-year-olds regularly, WPVI reported, and once strung the boys up by their feet and beat them as the couple laughed, Tait admitted to police.

“I’m not sure everything’s hit her yet,” Brenda Jones, Tait’s lawyer, told the Inquirer. “She’s holding up.”

The worst was reserved for Scott. The “discipline” included throwing him against a wall, knocking him off a chair with a punch and then taping him to the chair to keep him upright for more beatings, cops allege.

Fellenbaum beat Scott with a frying pan, a window rod and punched the boy over several days, police claim, eventually leaving him unresponsive and covered in vomit. As Scott lay dying, officials say, the couple went car shopping, picked up a pizza and even had sex.

One protester outside the courthouse explained why this case was so chilling.

“I wanted someone to speak up for me. No one spoke up for me,” 57-year-old Carol Houck, a victim of abuse, told the Inquirer. “I’m alive and well, and Scotty isn’t. So I wanted to speak up.”
