A judge in Massachusetts judge is expected to schedule a new trial date for former New England Patriots player Aaron Hernandez for the 2012 double murder of two men in downtown Boston.

Prosecutors accuse Hernandez of fatally shooting Safiro Furtado and Daniel de Abreu back in July 2012 after a brief altercation at a Boston nightclub. Hernandez has pleaded not guilty.

Jury selection in the case had been originally scheduled to start earlier this month. However the judge delayed the trial after Hernandez’ attorney launched an appeal to have evidence tossed from the case.

A police official close to the investigation told The Associated Press that the appeal centers on whether prosecutors should have access to Hernandez’s cell phone.

The judge is expected to set a new trial date on Tuesday at a scheduled pretrial conference.

Hernandez is already serving life in prison after he was convicted of the 2013 murder of Odin Lloyd, the man who was dating his fiancee’s sister.
