Gang rape case against NBA star Derrick Rose going to trial

Derrick Rose attempted to get a sexual assault civil case against him dismissed, but his appeal was rejected this week, and the new Knicks point guard is officially going to trial.

The trial is expected to begin on October 4th in Los Angeles, at approximately the same time Knicks training camp is scheduled to start, ESPN reported.

One of Rose’s ex-girlfriend accused him and his two friends of drugging and gang-raping her. The allegations were not reported until August 2015, almost two years after the alleged attack.

According to court documents released by The White Bronco, California district court judge rejected Rose’s motion for a summary judgment is because it remains questionable whether the victim, only identified as “Jane Doe,” consented to sex on August 27, 2013.

In a May filing, Rose stated: “This is not a rape case. It’s pure and simple extortion by a plaintiff who does not want anyone to be deposed because every lay witness in the case will shred plaintiff’s story.”

Rose’s attorneys explained that he and the woman were together for 20 months, and assert that text messages from before and after the alleged assault indicate that the woman was communicating lucidly enough to provide consent.

The court order reads: “Plaintiff’s ability to send text messages after she left the Beverly Hills residence does not establish as a matter of law that she was able to consent to sex.”

According to sports attorney Dan Werley, Rose did win motions to exclude or restrict the plaintiff’s expert witnesses and to separate the punitive damages aspect of the trial.

Rose, who was traded from the Bulls on June 22nd, has the option settle the case out of court before the start of the trial, for now, however, he will miss a portion of his first Knicks preseason training.
