Florida man accused of choking girlfriend during oral sex acquitted of murder

The Florida man who was on trial for killing his girlfriend during oral sex was found not guilty on Monday.

Richard Henry Patterson was acquitted of second-degree murder in the 2015 death of 60-year-old Francisca Marquinez.

Peterson claimed the victim had choked to death while performing oral sex.

Dr. Ronald Wright, the Broward County medical examiner, testified that it is possible that Marquinez died from asphyxiation.

Defense lawyer Ken Padowitz told the jury that the cause of the woman’s death was not clear.

Before the trial, Patterson’s attorneys filed a motion to allow the jury to see his penis to prove the “rough sex” argument, but the motion was rejected.

Peter Sapak, assistant state attorney, challenged why Patterson hadn’t contacted 911 after Marquinez died.

He also read jurors a text that Patterson had sent to his daughter the day after the episode.

“Your dad did something bad last night,” Sapak read. “I’m so, so sorry.”

The victim’s son, 41-year-old Omar Andrade, previously told the Daily News, that Patterson was a “desperate man trying to avoid being convicted of the crime.”

Marquinez was discovered dead in her residence at Margate’s Royal Palm Garden community in October 2015.
