A father in Georgia fatally shot his daughter’s boyfriend on Sunday after the young man reportedly shot her during a fight.

However, authorities have indicated that they don’t intend to charge the father with the murder.

The Hall County Sheriff’s Office said the boyfriend, 25-year-old Thomas McNulty, shot Jessica Rusk, 22, in the back during an argument at the residence they share with her parents in Gainesville, Georgia, WSOC-TV reported.

Rusk’s mother and father were home at the time of the incident at around 4:30 a.m., according to WSOC. Her mom called 911 after McNulty opened fire.

Soon after, her father, 57-year-old Floyd Rusk, shot and killed McNulty. Jessica Rusk was brought to a local hospital and was listed in stable condition.

“Obviously violence would be the last resort,” Lieutenant Scott Ware of the Hall County Sheriff’s Office said. “If you can avoid violence and call 911, we would obviously prefer that no one gets hurt. That would be the best-case.”

Although investigators have not filed charges against the father, the district attorney will review the case.

Before the altercation, McNulty had been fired as an IT contractor one week after he brought a gun to work and that claimed he forgot the firearm was in his pocket.
