Escaped inmate takes guard’s weapon kills man in South Texas

A sheriff in South Texas says department procedure was not followed when an inmate being transported by a lone deputy to a medical facility for treatment,  overpowered his guard, managed to escape and killed a man while on the run on Thursday.

The deadly incident occurred near the Mexican border around 1 p.m. in the South Texas city of Brownsville.

Two guards were scheduled to transport an inmate but only one was available to take 38-year-old Miguel Garcia to his appointment at a medical clinic, which is a violation of department policy, Cameron County Sheriff Omar Lucio said during a news conference on Friday.

As the officer transported the inmate, Garcia pulled a shank and slashed the deputy.

Miguel Diaz Garcia allegedly overpowered the deputy and escaped.

“He was able to go ahead and remove the handcuffs. And when the officer opened up the sliding door to get him out, he jumped the officer,” Lucio said.

Garcia then took the officer’s handgun and fled in the deputy’s vehicle.

Lucio said the fugitive entered a home nearby, where he fatally shot 56-year-old Mario Martinez in front of his wife, the Associated Press reported.

Garcia fled from the home in the couple’s car and was pursued by police. Garcia later died in a shootout with police.

The guard remains in stable condition at a local area hospital.
