Nebraska teacher arrested for birthday sex encounter with teen blames mental illness

A teacher in Nebraska, who was charged with having sex with a 16-year-old, carried on a “double life” — because she has a mental illness, her attorney asserted in court.

Emily Lofing, 27, who was a teacher at Nebraska City Middle School reportedly slept with the boy last year and was sentenced to 90 days behind bars, two years of probation, and 240 hours of community service on Monday.

Lofing’s attorney, Desirae Solomon, blamed her behavior on her work stress and a family history of depression, KWBE reported.

“That’s the tragedy of mental illness,” Solomon said to Judge John Steinheider. “It doesn’t know demographics… race.. age…and, when mental illness strikes, it can do so without any warning.”

Solomon said letters of support show that Lofing’s behavior was uncharacteristic.

“They speak to a period when Ms. Lofing was living a double life,” she noted. “People who have known her for her whole life were shocked at this behavior.”

However, Steinheider added that Lofing craftily avoided more severe charges.

“This alleged indiscretion took place on the victim’s 16th birthday,” the judge stated. “You were less than 24 hours from a felony.”

In Nebraska, the age of consent is 16. Lofing has been charged with misdemeanor debauching of a minor. She pleaded no contest and willingly gave up her teaching license.
