New Mexico man sent to prison for shooting at neighbor’s home arrested hours after release

A New Mexico man who just completed a sentenced for shooting at neighbors’ homes in Albuquerque was arrested again for firearms possession weeks after his release from prison.

Albuquerque Police say a probation officer conducting a check on 31-year-old Derek Foote at his residence on Friday discovered an assault rifle under a blanket on Foote’s bed.

KRQE-TV reported that Foote is now charged with being a felon in possession of a gun and is facing a parole violation.

A judge told Foote during a court hearing Saturday, that state prosecutors filed a motion to keep him remanded in custody until he goes to trial for the new offense.

Foote was released from prison in recent weeks after serving a six-month sentence for shooting at occupied structures in 2016.

A Two year suspended sentence was included in Foote’s plea deal last December.
