Colin Kaepernick has won an early victory against the NFL after his grievance was ordered to trial by an arbitrator.

The former San Francisco 49ers quarterback is claiming that NFL owners conspired to keep him out of the league because of his kneeling during the national anthem over social injustice.

Mark Geragos, the attorney for Colin Kaepernick posted a picture on his Twitter account on Thursday of the decision by arbitrator Stephen B. Burbank.

The grievance accuses the owners of violating union rules by colluding to keep him off any NFL roster since 2017 when he became a free agent, according to ESPN.

The actions of Kaepernick started a  wave of protests across the NFL in 2016,  which included players kneeling during the national anthem to protest police brutality and racial inequality.

The protests have since transpired into one of the most polarizing issues in sports, with President Trump loudly urging the league to suspend or cut players who demonstrate during the anthem.
