Officials in Texas revealed that a Border Patrol agent shot and wounded a Honduran man who reportedly threw rocks at agents as they attempted to arrest him after he had illegally come into the United States.

Last Wednesday, federal prosecutors announced that Leivin Pineda is in federal custody after he was taken to a hospital to receive medical treatment for a gunshot wound, according to a Justice Department press release.

Investigators indicated that Border Patrol agents spotted Pineda walking along a road near the U.S.-Mexico border next to Del Rio.

Pineda tried to escape into the brush on foot and during the chase, he threw softball-sized rocks at the agents’ heads.

One agent then opened fire on the 48-year-old in the upper chest/left upper arm area.

Pineda is facing 20 years behind bars if he is found guilty of assault.
